Mobility 3 Plus Terms & Conditions

OUR CONTRACT WITH YOU
- Introduction 1.1 These Terms & Conditions outline the agreement between Mobility 3 Plus (referred to as “we”, “us”, or “our”) and the customer (referred to as “you” or “your”). Please read these terms carefully before commissioning our services. By engaging us for mobility bathroom installations or related services, you agree to these terms.
CARRYING OUT THE JOB
Scheduling and Time Estimates 2.1 Upon booking, we will provide you with a proposed date and time for the commencement of the work. We will also estimate the duration of the job, but please note this is only an estimate; the actual time required may vary. 2.2 We prioritize emergency situations whenever possible but cannot guarantee immediate service due to factors beyond our control. 2.3 While we strive to meet the agreed schedule, we are not liable for delays caused by factors outside our control, such as adverse weather, traffic disruptions, or supplier delays. In such cases, we will notify you promptly and provide an option to reschedule or cancel the job.
Customer Responsibilities 3.1 To ensure smooth service delivery, you must: (a) Provide clear and safe access to the premises. (b) Ensure that the work area is free from obstructions and that necessary permissions are in place. (c) Supply any materials required for the work if agreed upon beforehand. Failure to provide suitable materials may result in delays or additional charges for rescheduled visits.
Completion of Work 4.1 Upon completion, our engineer will provide you with a Job Sheet detailing the work done, time spent, and total charges. You will be required to review and sign this document. Any discrepancies should be reported to us immediately via phone at 01482 236483 or by emailing us at mobility3plus@gmail.com.
PRICE AND PAYMENT
- Pricing Structure 5.1 The cost of our services includes labor, parts, and materials. 5.2 Labor charges are based on either an hourly rate or a fixed price as agreed upon at the time of booking: (a) For hourly or half-hourly bookings, you will be charged from the time our engineer arrives on-site until the work is completed. (b) For fixed-price bookings, the agreed-upon price covers labor and, if applicable, specified parts. Any additional parts required will be charged separately. 5.3 Payments are due within 7 days of job completion.
OUR LIABILITY TO YOU
Liability and Damages 6.1 We are responsible for any damage caused by our negligence during the job. However, we are not liable for pre-existing conditions, issues arising from hidden defects, or any damages incurred while accessing necessary work areas. 6.2 Our services are for private use only, and we do not assume liability for business losses such as lost profits, business interruptions, or opportunities.
Exclusions and Limitations 7.1 We do not limit or exclude liability for: (a) Death or personal injury caused by our negligence. (b) Fraud or fraudulent misrepresentation. (c) Any other liability that cannot be excluded by law.
GUARANTEE
- Workmanship and Materials 8.1 Our work and materials are guaranteed for a period of 5 years from the start date of the installation, except in cases covered by clauses 8.3 and 8.4. 8.2 Certain products may carry a manufacturer’s warranty. Please refer to the specific warranty terms provided with the product. 8.3 The guarantee does not cover: (a) Damage caused by deliberate actions, accidents, or misuse. (b) Issues arising from failure to follow our advice or manufacturer’s guidelines. (c) Modifications made to our work or materials without our consent. (d) Temporary repairs or emergency solutions, which are noted on the Job Sheet and carry a limited 10-day guarantee.
CANCELLATION POLICY
Your Right to Cancel 9.1 You may cancel or reschedule your appointment without charge if you notify us at least 24 hours in advance. 9.2 Cancellations made with less than 24 hours’ notice may incur a £25 cancellation fee. 9.3 If you cancel after work has commenced, you will be charged for the labor and materials used up to that point.
Our Right to Cancel 10.1 We reserve the right to cancel the job due to events outside our control or due to unavailability of key personnel or materials. In such cases, any advance payments will be fully refunded.

- Data Protection 12.1 We will use your personal information solely to perform the work, process payments, and inform you of related services. You may opt-out of marketing communications at any time. 12.2 We may share your data with credit reference agencies where necessary, but it will not be shared with third parties without your consent.
OTHER IMPORTANT TERMS
Transfer of Rights 13.1 We may transfer our rights and obligations under these terms to another organization, but this will not affect your rights.
Governing Law 14.1 These Terms are governed by the laws of England. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England.
